Four companies have been fined for cartel co-operation
Four competing companies have entered into agreements on pricing and sharing of costumers within the business concept ‘Nye Visioner’. The Danish Competition Council has issued fines to the companies for the infringements.
Four companies have admitted that they have infringed the competition law’s prohibition against anti-competitive agreements. The infringements have taken place within the business concept ‘Nye Visioner. The companies are:
- Make Life Less Complicated & SpeakUp v/David Munk Møller (previously Nye Visioner & SpeakUp v/David Munk Møller)
- Work Efficiently (previously NYE Visioner)
- Work Simple (previously NYE Visioner v/Anette Obenhausen)
- COSMO v/Jette Lunddal Larsen (previously NYE Visioner v/Jette Lunddal Larsen)
The concept ‘Nye Visioner’ encompasses among other things courses within personal planning and efficiency, meeting management, stress prevention and management training. The developer of ‘Nye Visioner’ has – in return for a provision – made the concept available to a number of companies that then have become partners in ‘Nye Visioner’.
The four partner companies have entered into agreements on pricing and sharing of customers within ‘Nye Visioner’. The infringements have taken place in periods that have lasted from four years and four months and up to seven years and ten months.
The companies have accepted fines of 10.000-90.000 DKK for the infringements. The size of the fines reflect the severity of the infringements, the duration of the infringements, the companies’ turnovers, and the fact that the fines cannot exceed 10 percent of the companies’ annual turnovers. In addition, it has been an extenuating circumstance that the companies have contributed to the investigation of the case.
The Competition and Consumer Authority is currently investigating whether more companies are part of illegal agreements within ‘Nye Visioner’. If the investigations lead to a decision from the Danish Competition Council or to the Danish Competition Council issuing more fines, this will be published.
