Denmark: Fine of DKK 500,000 to manufacturer of sportswear for retail price maintenance
On May 7, 2021, the City Court of Aalborg sentenced the Danish manufacturer of sports clothes Fusion ApS to pay a fine of DKK 500.000 (€ 67,242) for resale price maintenance. Moreover, a member of the management was sentenced to pay a fine of DKK 50.000 (€ 6,724).
Fusion ApS, the manufacturer of sportswear of the brand "Fusion", has been sentenced to pay a fine of DKK 500,000 (€ 67,242). In 2017, Fusion demanded that the company’s dealers followed a minimum price and the dealers were not allowed to sell Fusions sportswear at a price below the recommended price. Fusion has therefore infringed the prohibition on resale price maintenance in the Danish Competition Act. A member of the management was sentenced to fine of DKK 50,000 (€ 6,724) for contributing to the infringement.
The case started in December 2017 with a complaint to the Danish Competition and Consumer Authority from one of Fusion’s dealers. After a brief investigation, the Danish Competition and Consumer Authority decided to hand the case over to the State Prosecutor for Serious Economic and International Crime. The State Prosecutor investigated the case and initiated the criminal proceedings.
