Fine of DKK 1 million to Icon Hairspa
The High Court sentenced the Danish distributor of hair products Icon Hairspa A/S for resale price maintenance. Icon Hairspa A/S de-manded that the company’s dealers followed the recommended retail price as minimum price when selling “Kevin Murphy” hair products.
On February 15, 2019, The City Court of Næstved imposed a fine of DKK 1,000,000 (€ 134,000) on Icon Hairspa as well as DKK 100,000 (€ 13,400) on a member of the management. Now the High Court has upheld the ruling.
Icon Hairspa has infringed the prohibition on resale price maintenance in the Danish Competition Act in the period from the beginning of 2016 to the beginning of 2017. Icon Hairspa demanded that the company’s dealers followed the recommended retail price as minimum price when selling “Kevin Murphy” hair products.
The case started in 2016 with a complaint to the Danish Competition and Consumer Authority from one of the dealers of the hair products. The complaint gave reason to believe that the prohibition against resale price maintenance had been violated.
Therefore, the Danish Competition and Consumer Authority decided to hand the case over to the State Prosecutor for Serious Economic and International Crime. The State Prosecutor investigated the case and initiated the criminal proceedings.
