Denmark: ”ActionSportGames pays fine in settlement for resale price maintenance”

On April 30, 2015, ActionSportGames A/S, a Danish supplier of hardball-gear, an activity similar to paintball, entered into a settlement with the Danish Public Prosecutor for Serious Economic and International Crime for infringing section 6 of the Danish Competition Act by imposing resale price maintenance.

Accordingly ActionSportGames accepted to pay a fine of DKK 320.000 (€ 42.666). 

The infringement took place in the period from mid-2011 until late 2012. 

The Danish Competition and Consumer Authority took up and investigated the case on the basis of a tip and turned the case over to the Danish Prosecutor for Serious Economic and International Crime when it found the Danish Competition Act to be breached. The case also contributed to a TV program on resale price maintenance back in 2012 together with two other Danish companies in the field of clothes: Vila A/S and Hummel A/S. Vila A/S closed their case with a settlement and paid a fine of DKK 1.6 million (€ 213.333) in October 2013. The case against Hummel is not yet settled.
