Long-standing Cartel Among Kiosks at Himmelbjerget
Hotel Himmelbjerget, which owns Bjergkiosken, has been fined DKK 250,000 for Bjergkiosken's participation in a cartel with its competitor, Ugleboden. For more than 25 years, the kiosks have agreed to stay away from each other's customers. The owner of Ugleboden has been granted full immunity from fines in the case.
Two kiosks at Himmelbjerget have, for more than 25 years, had an illegal agreement under which Bjergkiosken – owned by Hotel Himmelbjerget – exclusively had the right to sell food and beverages, while Ugleboden – owned by Komiteen til bevarelse af Mindesmærker på Himmelbjerget – exclusively had the right to sell souvenirs.
The market-sharing agreement constitutes a violation of the competition law's prohibition against anti-competitive agreements. The violation occurred from at least 1997 until early 2023.
Hotel Himmelbjerget has admitted to the violation and will pay a fine of DKK 250,000, while Komiteen til bevarelse af Mindesmærker på Himmelbjerget has been granted immunity from fines under the leniency provisions of the competition law.
