The Danish Competition and Consumer Authority launches draft guidelines on joint bidding under competition law

The Danish Competition and Consumer Authority has published draft guidelines on joint bidding consortia. The draft guidelines contain, inter alia, information on the assessments undertakings shall make when they consider bidding for a contract together with one or more undertakings.

The Director of the Danish Competition and Consumer Authority, Jakob Hald, says:

”We have identified that among Danish undertakings there has been uncertainty as to when they may bid jointly in a consortium. We would very much like to reduce this uncertainty. Therefore, we are sending out these draft guidelines on how joint bidding consortia should be viewed from a competition law stand point. A public hearing has been opened so that undertakings and other stakeholders can comment on them.”

”The draft guidelines include a number of examples from praxis that show that we in Denmark are in line with the Commission and other EU countries. We would very much like to include more examples from praxis from other countries in the final version of the guidelines. We therefore invite the Commission and other EU countries and stakeholders to send their comments to us.”
