In June 2005 the Danish Competition Council (DCC) recommended the Minister of Transport & Energy to repeal section 3 and 7 of the Act on Copenhagen Free Port. On the basis of its analysis, the DCC concluded that section 3 of the Act on Copenhagen Free Port distorts competition on the markets for services for cruise liners and container handling. Section 3 contains an exclusive right for Copenhagen Malmö Port AB (CMP) to perform several types of harbour services in Copenhagen Free Port. The legal monopoly of CMP prevents other companies from offering these types of services in the Free Port.
DDC also found that section 7 of the Act on Copenhagen Free Port distorts competition on the market for commercial tenancy. Section 7 contains an exemption for taxes of any kind on real estate in Copenhagen Free Port.
In May 2007 the Minister of Transport & Energy has responded to the recommendation of DDC. The Minister has stated that the geographical area of Copenhagen Free Port will be reduced by the end of 2008. The area will be reduced due to the construction of a Metro line in Copenhagen. The Metro line will be partially financed by the disposal of an area in Copenhagen Free Port to be used for house building.
The Minister of Transport & Energy will also secure access on free and equal terms for competitors to the Port of Copenhagen outside Copenhagen Free Port from 2008. The Minister has informed the DDC that all cruise liners can freely choose their baggage handler in Port of Copenhagen from the season 2008. Regarding container handling the Minister have stressed that container handling to a large extent will continue in the Free Port, however, other operators will have the opportunity to rent areas in the harbour for commercial purposes.
DCC appraise the reduction of the area of Copenhagen Free Port and the initiative to open the markets outside Copenhagen Free Port to a substantial extent. This will eliminate the anti-competitive provisions in section 3 and 7 of the Act on Copenhagen Free Port.
